| Guys, you/we are being bamboozled.
There are very specific laws on the books in Washington State that defines what is required to license a vehicle, and there are no laws that define what may not be licensed.
You can cobble together a bucket of bolts from your garage legally and have it inspected and obtain a license with no VIN whatsoever, one will be assigned to you as long as you meet the legal requirements in the RCW and WAC.
There is also a very clear appeal process to follow if your plate is revoked, denied, etc.
What we are dealing with is policy, not law. The RCW of WA is what the courts must follow, please take seriously the link below. It is an easy matter to file an appeal with the superior court in your jurisdiction if you are denied an application or your plate is confiscated. Remember 10 days!!! or it becomes fixed, period.
You can do a google search of the relevant RCW's and WAC's.
Here is the appeal process.
RCW 46.12.240 Appeals to superior court from suspension, revocation, cancellation, or refusal of license or certificate. (Effective until July 1, 2011.) (1) The suspension, revocation, cancellation, or refusal by the director of any license or certificate provided for in chapters 46.12 and 46.16 RCW is conclusive unless the person whose license or certificate is suspended, revoked, canceled, or refused appeals to the superior court of Thurston county, or at his or her option to the superior court of the county of his or her residence, for the purpose of having the suspension, revocation, cancellation, or refusal of the license or certificate set aside. Notice of appeal must be filed within ten days after receipt of the notice of suspension, revocation, cancellation, or refusal. Upon the filing of the notice of appeal the court shall issue an order to the director to show cause why the license should not be granted or reinstated, which order shall be returnable not less than ten days after the date of service thereof upon the director. Service shall be in the manner prescribed for service of summons and complaint in other civil actions. Upon the hearing on the order to show cause, the court shall hear evidence concerning matters with reference to the suspension, revocation, cancellation, or refusal of the license or certificate and shall enter judgment either affirming or setting aside the suspension, revocation, cancellation, or refusal.
(2) This section does not apply to vehicle registration cancellations under *RCW 46.16.710 through 46.16.760. [2010 c 8 § 9006; 1987 c 388 § 8; 1965 ex.s. c 121 § 42; 1961 c 12 §46.20.340 . | Who will step up, get an attorney and file an appeal? I've got $100 to help wlith the expense who else wants to get in on this? Make it a class action. Let's make the state walk the walk.

| Thinking of getting a 2010 Husaberg FE390 and the title does not state it is for ORV use only. The eight digit is a 0.
Does anyone own a Berg FE390 that is plated been revoked? Does anyone know if these bike are safe from the plate chopping block? | |

| Just to recap
The 0 in the 8th spot is KTM only.
After talking with the State Patrol and DOL both departments do not have a clue if these bikes are street legal (even giving them the specific vin number). If you did not buy it from a dealer you will have to provide a letter from the manufacturer (MSO) saying it's street if they think it is not street legal. | |

| KTM now and who going to be next? If WA state wants to do this sh-t to other bikes then they will and it does not have to make since.
I'm thinking of just getting a Factory Street legal KTM 450 and be done with it and not worry about the plate getting pulled.

| I went to a local DOL today and got the run around. My 8th digit is a zero, there is no brand on the frame or title that says off road use only. I was also told to get a letter from the manufacturer. Yeah right, like a multi-billion dollar company like Honda is gonna even respond to me. Let alone specify that it was manufactured to be used on the street. SB 5008 has been passed, but won't go into effect until 1/1/2012. In reading that I found out that the motorcycle shop that does the inspection can charge up to $100 for inspecting each bike. I still think there is a way around all this BS, and am not giving up quite that easily. I will visit every DOL I can find until one of them just hands me a plate. I also fired off a letter to DOL as well to see what they had to say. I will keep everyone posted on my progress. | |

The DoL will not budge until WAC308-94A-005 is revised. That requires going through a State rulemaking process and without effort we will be fortunate to get it done by 1-jan2012. Yep, I know it's sucky slow, but at least we are moving the process forward. It is important that WAC308-94A-005 is done properly. | |

| HAH!!! I did it!!!! Went to another DOL and they said I was correct about the 8th digit, and then gave me a dual registration... ORV and highway. I am now sporting a license plate on a now street legal motorcycle Anyone with a zero as the 8th digit in their VIN that can't get licensed elsewhere, go to the Yelm DOL. | |
